Welcome to DLang, a German language learning application. These Terms and Conditions (“Terms”) are a legal agreement between you (“User,” “you”) and the DLang service (“DeepLang,” “we,” “us” or “our”). By downloading, accessing, or using DLang (the “App” or “Service”), you agree to be bound by these Terms, as well as our Privacy Policy (incorporated herein by reference). If you do not agree with these Terms, you must not use the App.
We may update or modify these Terms from time to time. If we make material changes, we will provide notice within the App or via email. By continuing to use the Service after any revisions become effective, you agree to the updated Terms. The “Last Updated” date at the top of this document indicates the latest revision.
DLang is a language learning application focused on helping users learn German. The App provides various features such as interactive lessons, exercises, quizzes, and AI-generated content (including text, audio, and images) to facilitate your learning. Some content in DLang is generated by artificial intelligence to provide personalized and dynamic educational material. DLang is offered for personal, non-commercial use to support your language learning goals.
Please note that DLang is an educational tool and not an accredited academic program or a professional advisory service. While we strive to provide helpful and accurate language content, we do not guarantee that using the App will achieve any specific learning outcomes. The Service is provided on an “as is” basis for your educational enrichment, and you are responsible for how you use or interpret the information provided.
We reserve the right to add, change, or remove features and content of the App at any time, either on a temporary or permanent basis, with or without notice. We are not liable for any modification, suspension, or discontinuation of any part of the Service.
Account Registration: To use DLang, you may need to create a user account. You can sign up using a third-party account (such as Google or Apple single sign-on) or by providing a valid email address and creating a password. You must provide accurate and current information during registration and keep your account information updated.
Third-Party Login: If you choose to register or log in via Google, Apple, or another third-party service, you authorize DLang to collect and use certain information from that account (such as your name and email address) as permitted by the third party’s terms and your privacy settings. Your use of third-party login options must also comply with those third parties’ own terms of service.
Age Requirement: You must be at least 13 years old to use DLang. If you are under the age of majority in your jurisdiction (generally 18 years in many countries), you should use the App only with the involvement and consent of a parent or legal guardian. By creating an account, you represent and warrant that you meet the applicable age requirement and have the capacity to enter into this agreement. We do not knowingly collect personal data from children under 13; if we become aware of such data, we will delete it.
Account Security: You are responsible for maintaining the confidentiality of your account credentials (password or third-party login details) and for all activities that occur under your account. You must notify us immediately at our contact email if you suspect any unauthorized access or security breach in your account. DLang will not be liable for any loss or damage arising from your failure to secure your account.
Single Account: Each user may create only one account, and you may not sell, transfer, or allow others to access your account. We reserve the right to suspend or terminate duplicate or shared accounts.
DLang offers a free basic version of the Service (with limited features) and a premium subscription plan (“DeepLang Premium” or “Subscription”) that provides expanded content and features. The specific features available in the free version and the premium version are described in the App or on our website. We reserve the right to modify the features of the free or paid tiers from time to time.
Free Version: The free version of DLang may be supported by third-party advertisements. By using the free Service, you agree that DLang may display ads within the App. We do not endorse any products or services advertised, and any interactions or transactions with advertisers are solely between you and the advertiser. We are not responsible for the content of ads or any claims they make. If you prefer an ad-free experience, you may consider upgrading to the premium Subscription.
Premium Version: Subscribers to DLang Premium gain access to additional content and features, which may include (for example) advanced lessons, AI-driven personalized exercises, offline access, or an ad-free interface. Premium content is accessible only while your Subscription is active and in good standing. The Subscription may be offered on a periodic basis (e.g., monthly or annually) and is subject to the payment of subscription fees as described below.
Billing and Auto-Renewal: By purchasing a DLang Premium subscription, you agree to pay the applicable subscription fees and any taxes incurred (e.g., VAT) at the rate in effect when the charges are incurred. Subscriptions are billed in advance on a recurring basis (such as monthly or yearly) as per the plan you select. Auto-renewal: Your Subscription will automatically renew at the end of each billing period unless you cancel it beforehand. You authorize us (or the applicable app store or payment processor) to charge the subscription fee to your provided payment method on each renewal date.
Payment Processing: Subscription payments may be processed by the platform through which you subscribed. For example, if you subscribed via the Apple App Store or Google Play Store, the respective store will handle billing and payment (in which case their billing terms apply in addition to ours). If you subscribed via our website, payments might be processed by a third-party payment processor (such as Stripe or PayPal). We do not collect or store your full payment card details when a third-party processor is used; such information is handled securely by the payment provider.
Cancellation: You can cancel your DLang Premium subscription at any time. If you purchased through an app store, you must manage and cancel your Subscription through your Apple ID or Google Play account settings (or other applicable platform settings). If you purchased on our website, you may cancel through your account dashboard or by contacting our customer support. Cancellation will take effect at the end of the current billing period, and you will retain access to premium features until that period expires. We do not generally provide refunds or credits for partial subscription periods or unused content, except where required by law or at our discretion.
Changes to Fees: We reserve the right to change the price of the Subscription or any chargeable service. If the subscription fee changes, we will notify you in advance (for example, through the App, website, or via email). Fee changes will become effective at the start of the next billing cycle following the notice. If you do not agree to a fee change, you may cancel your Subscription before the new price takes effect. Continuing to use the premium Service after the price change becomes effective constitutes your acceptance of the new price.
Free Trials and Promotions: DLang may occasionally offer free trials or promotional offers for the premium Subscription. If you sign up under a free trial, you will have access to premium features for the duration of the trial period. Unless otherwise stated, at the end of the trial period, you will be charged the regular subscription fee and enrolled into a paid Subscription if you do not cancel before the trial ends. Eligibility for free trial offers is at our sole discretion, and we may limit such offers to prevent abuse.
Right of Withdrawal (EU Users): If you are a consumer residing in the European Union or a jurisdiction with similar consumer protection laws, you may have a legal right to withdraw from a subscription purchase within fourteen (14) days of your purchase (cooling-off period). However, if you wish to access DLang Premium immediately, you expressly consent to us providing the digital content/services right away and acknowledge that by doing so you waive your statutory right of withdrawal. This means that once access to the premium Service has begun (e.g., you start using premium features after purchase), you no longer have the right to cancel and receive a refund for the initial subscription period, except as provided in our refund policy or required by law.
We expect users to use DLang in a lawful and respectful manner. By using the App, you agree not to misuse the Service or use it for any harmful or unauthorized purposes. Prohibited conduct includes, but is not limited to, the following:
We reserve the right to investigate and take appropriate action (including suspension or termination of accounts and legal action) against anyone who, in our reasonable judgment, violates these conduct rules or any other provision of these Terms.
Your privacy is important to us. Our practices regarding the collection, use, and disclosure of user data are described in our Privacy Policy. By using DLang, you agree that we can collect and use your information in accordance with our Privacy Policy and applicable data protection laws.
Personal Data: DLang limits the personal data it collects to what is needed to provide and improve the Service. This may include your email address, name or nickname, account login credentials, and information about your learning progress and usage of the App (such as lesson completion, scores, or preferences). We may also collect technical data such as device type, operating system, and general location (e.g., country) for analytics and troubleshooting purposes.
Use of Data: The personal data we collect is used to personalize your learning experience, track your progress, sync your account across devices, communicate with you about the Service (e.g., sending important updates or marketing communications if you’ve opted in), and to analyze and improve our App. If you provide feedback or contact us for support, we will use the information you give us to respond and address your request.
Analytics: DLang uses third-party analytics services (such as Google Analytics or similar tools) to gather anonymous or aggregated information about how users interact with the App. This data helps us understand usage patterns and improve the product. These third-party analytics providers may use cookies or mobile identifiers to perform their services. The information collected will be subject to the third party’s privacy policy as well as our own.
Advertising and Tracking: If you use the free version of the App, third-party advertisers may collect certain information from your device to provide targeted ads. This may include an advertising identifier, and information about your device or usage. Please refer to our Privacy Policy for details on how advertising partners collect and use data and how you can opt out of personalized ads if you wish.
Data Protection: We are committed to complying with applicable privacy and data protection laws, including the EU General Data Protection Regulation (GDPR) and relevant U.S. privacy laws. We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is completely secure, so we cannot guarantee absolute security.
User Rights: Depending on your jurisdiction, you may have certain rights regarding your personal data, such as the right to access, correct, or delete your information, and to object or restrict certain data processing. Please review our Privacy Policy for more information on how you can exercise these rights or contact us at our support email for assistance. By using the Service, you acknowledge that you have reviewed our Privacy Policy.
DLang integrates several third-party services to provide key functionalities of our App. By using DLang, you acknowledge and agree that your information and content may be shared with or processed by these third-party services, solely for the purposes of delivering the features of DLang. Such third-party services include, but are not limited to:
We strive to work only with reputable third-party providers and to contractually require them to protect your data in line with applicable laws. However, we do not have direct control over these services and therefore cannot guarantee their performance, availability, or security. Your use of DLang constitutes your understanding that the Service relies on such third parties. We are not liable for damages or losses arising from the actions or content of third-party services integrated into DLang, except as required by law.
When you use features that involve third-party services (such as AI content, text-to-speech, or generated images), you agree that we may send the necessary data to these providers to enable those features. If you do not agree with the use of these third-party services, please refrain from using the portions of the App that rely on them. For more information, please review our Privacy Policy which further explains data sharing with service providers.
DLang utilizes advanced artificial intelligence (AI) and neural network technologies to create or enhance some of its educational content (including generated text responses, audio, and images). While this allows for a personalized and rich learning experience, it also means that content is machine-generated and may occasionally be imperfect. By using the App, you acknowledge and accept the following regarding AI-generated content:
We continuously work on improving our AI models and content filters to provide a better experience. However, you understand that AI is an evolving technology and not perfect. Your use of DLang and its AI features signifies that you accept these inherent limitations. If you are ever in doubt about a piece of content or find it problematic, please double-check with other resources or reach out to us for clarification.
Ownership of Content: All content and materials available on or through DLang, including but not limited to software, text, lessons, questions, explanations, exercises, images, graphics, audio clips, videos, logos, trademarks, and the overall design and compilation of such content (collectively, the “Content”), are the property of DLang or its licensors and are protected by intellectual property laws (such as copyright, trademark, and patent laws). This includes any content generated by the App’s AI components, which we consider part of the Service’s Content provided to you.
License to You: Subject to your compliance with these Terms, DLang grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the App and its Content for your own personal, non-commercial language learning purposes. You may download or print copies of materials (e.g., lesson notes or vocabulary lists) for your personal use only. No other use of the Content is authorized.
Restrictions: You agree that you will not, and will not permit anyone else to, do the following: (a) copy, distribute, modify, publish, transmit, perform, display, create derivative works of, or otherwise exploit any part of the Content or Service except as expressly permitted in these Terms; (b) reverse engineer, decompile, or attempt to extract the source code of the App or any part of the Service, except to the extent allowed by law; (c) remove or obscure any copyright, trademark, or other proprietary notices displayed in the App or contained in the Content; (d) use any trademarks, logos, or brand names of DLang (including “DeepLang”) without our prior written permission.
User Content: In the course of using DLang, you may input or create content of your own, such as written answers, recordings of your voice, or messages in a community forum if one exists (“User Content”). You retain all rights to your User Content. However, by submitting or creating User Content through the Service, you grant DLang a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, display, adapt, and distribute your User Content as necessary to operate and improve the Service (for example, to check your answers, provide feedback, store your progress, or train our models to better tailor the learning experience). We will only use your User Content in accordance with our Privacy Policy. You are solely responsible for any User Content you provide and you represent that your User Content does not violate any laws or infringe anyone’s rights.
Feedback: If you choose to provide suggestions, ideas, or feedback about DLang or how to improve it, you agree that such feedback is given voluntarily and we are free to use it however we see fit, without any obligation to you.
Third-Party Content: Some content in the App may be provided by third parties (for example, third-party libraries, open-source components, or content licensed from publishers). Such content remains the property of its respective owners. Use of third-party content may be subject to additional terms from those owners, which will be indicated in the App or documentation if applicable. DLang respects the intellectual property rights of others and expects users to do the same. If you believe that any content in the App infringes your copyright or other intellectual property rights, please contact us with details (see the Contact Information section) so we can investigate and address the issue, in accordance with applicable law.
YOUR USE OF DEEPLANG IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE (INCLUDING THE APP AND ALL CONTENT, FUNCTIONS, AND FEATURES MADE AVAILABLE THROUGH IT) IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
DEEPLANG AND ITS DEVELOPERS, SUPPLIERS, AND PARTNERS SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES AND REPRESENTATIONS, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR SYSTEM INTEGRATION. WE MAKE NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, OR THAT YOUR ACCESS TO THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS, IF ANY, WILL BE CORRECTED. WE MAKE NO GUARANTEES AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE (INCLUDING ANY LANGUAGE TRANSLATIONS, LESSON MATERIAL, OR AI-GENERATED CONTENT).
No advice or information, whether oral or written, obtained by you from DLang or through the Service shall create any warranty not expressly stated in these Terms. While we hope you find DLang useful and enjoyable, we do not warrant or guarantee any level of improvement or success in your language learning endeavors.
Jurisdictional Note: Some jurisdictions do not allow the exclusion of certain warranties or conditions. To the extent that such laws apply to these Terms, some of the above exclusions may not apply to you. In such cases, DeepLang’s warranties will be limited to the minimum extent permitted by applicable law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEEPLANG, ITS OWNER(S), DEVELOPERS, AFFILIATES, LICENSORS, OR BUSINESS PARTNERS, NOR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF OPPORTUNITY, BUSINESS INTERRUPTION, LOSS OF GOODWILL, LOSS OF DATA, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER OR NOT THE DAMAGES WERE FORESEEABLE AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN ADDITION, TO THE FULLEST EXTENT PERMITTED BY LAW, DEEPLANG’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF THE SERVICE, REGARDLESS OF THE FORM OF THE ACTION, SHALL NOT EXCEED THE TOTAL AMOUNT (IF ANY) THAT YOU HAVE PAID TO US FOR THE SERVICE IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE CLAIM (OR, IF GREATER, ONE HUNDRED U.S. DOLLARS (USD $100)). IF YOU HAVE PAID NO FEES, DEEPLANG SHALL HAVE NO LIABILITY IN CONNECTION WITH THE SERVICE, TO THE EXTENT PERMITTED BY LAW.
Exceptions: Nothing in these Terms shall operate so as to exclude or limit liability which cannot be excluded by law. This includes, for example, any liability for personal injury or death caused by our negligence or for our fraud or fraudulent misrepresentation. Additionally, because some jurisdictions do not allow the exclusion or limitation of liability for certain damages, in such jurisdictions our liability shall be limited to the smallest amount permitted by law.
You agree to defend, indemnify, and hold harmless DLang and its affiliates, and their respective officers, directors, employees, agents, and partners, from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) that arise out of or relate to: (a) your use or misuse of the App or Service; (b) your violation of any of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any rights of another person or entity (including intellectual property rights or privacy rights). We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (in which case you agree to cooperate with us in asserting any available defenses). This indemnity obligation will survive the termination of your account and use of the Service.
By You: You may stop using DLang at any time. You may also delete your account by following the procedures in the App or contacting us for assistance. Deleting your account will terminate your rights to access the Service, and any data associated with your account may be deleted as described in our Privacy Policy. If you cancel a premium Subscription, the cancellation will be effective at the end of your current billing period (see Section 5 on Cancellation).
By Us: We reserve the right to suspend or terminate your access to the Service (or any portion thereof) at any time, with or without notice, if we reasonably believe: (i) you have violated these Terms or any applicable law; (ii) you create risk or possible legal exposure for us; (iii) our provision of the Service to you is no longer commercially viable; or (iv) we have decided to discontinue the Service (in whole or in part). We will make a reasonable attempt to notify you of such termination or suspension, either through the Service or via the email associated with your account.
Effect of Termination: Upon any termination of this agreement, whether by you or by us, your right to use the Service will immediately cease. You will not be entitled to any refunds of any fees (except as required by law or at our discretion). Sections of these Terms that by their nature should survive termination (such as intellectual property rights, disclaimers, limitation of liability, indemnification, and governing law) will survive.
Data Retention: If your account is terminated or deleted, we may permanently delete your User Content and data from our systems, in accordance with our Privacy Policy and applicable law. We are not liable for any deletion of data associated with an account termination. It is your responsibility to save any important data or progress records elsewhere if you desire.
DLang is an evolving service, and we may need to update or change the Service and these Terms from time to time.
Changes to Service: We may add, modify, or remove features, content, or aspects of the App at any time. We may also impose usage limits or restrict access to parts or all of the Service without liability. We will endeavor to notify users of major changes to the Service (for example, if we plan to discontinue a core feature or the entire Service), but there may be instances where we need to make changes without notice. You acknowledge that the form and nature of the Service may change from time to time without prior notice to you.
Changes to Terms: We also reserve the right to modify these Terms at any time. If we make material changes to the Terms, we will notify you by posting the updated Terms on our website and/or within the App and updating the “Last Updated” date. In some cases, we might also notify you via email or via an in-app alert. It is your responsibility to review these Terms periodically. If you do not agree to the updated Terms, you should stop using DLang before the changes take effect and, if applicable, cancel any paid Subscription. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of those changes.
Governing Law: To the extent permitted by law, this Agreement and any dispute or claim (including non‑contractual disputes or claims) arising out of or in connection with it or its subject matter shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. If you reside in a jurisdiction that mandates a different governing law for consumer contracts that cannot be varied by agreement, that law shall apply to those provisions that cannot be altered by contract.
Jurisdiction: Subject to the paragraph above, you and DLang agree that any judicial proceedings (other than small‑claims actions) to resolve claims or disputes arising out of or in connection with these Terms or the Service will be brought exclusively in the courts of competent jurisdiction located in Berlin, Germany, unless applicable consumer‑protection law requires otherwise. Notwithstanding the foregoing, if you are a consumer located in the European Economic Area (EEA) or the United Kingdom, you may bring proceedings in your country of residence under the laws of that country.
Class Action Waiver: To the extent permitted by applicable law, you and DLang agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative action. Unless both you and DLang agree, no court or arbitrator shall consolidate or join the claims of multiple parties or otherwise preside over any form of a consolidated, representative, or class proceeding.
Export Compliance: You acknowledge that the App and its software may be subject to export‑control laws. By using DLang, you represent and warrant that you are not located in a country that is subject to export restrictions or embargoes, and that you are not listed on any government list of prohibited or restricted parties. You agree to comply with all applicable export and re‑export control laws and regulations in using the Service.
